In November 2003, Anthony Sammut had been convicted for ploughing a field that was not his and for relapsing in view of previous

convictions.

Mr Sammut appealed the first court’s decision and said he had several receipts showing he was in fact renting the field in question and therefore was not trespassing on anyone’s property.

Charles and Emanuel Micallef, the owners of the field, had testified in the original case and said on 5 November 2003 they were trapping in the field when Mr Sammut had come to plough it.

The court ruled he was guilty of trespassing but the incident only happened once, not over a period of several months as the charges had claimed.

The court was presided over by Mr Justice David Scicluna.
