Karim Barboush filed an application last Tuesday demanding to be released following a magistrates’ court ruling declaring his detainment to be illegal.

Chief Justice Vincent Degaetano said he could not help but take note of the unorthodox way Mr Barboush’s case was handled in the magistrates’ court. On Monday, the man’s arrest was declared illegal and he was to be released immediately, when this did not happen, Mr Barboush filed an application demanding to be released.

Upon review of this application, Chief Justice Degaetano ruled the man’s case was to be reassessed and in the meantime, he is to be detained. Mr Barboush is therefore in the exact same position he had been in before the magistrates’ court ruled his arrest to be illegal.
