A Libyan man was acquitted of assaulting two local wardens after a court ruled that insufficient evidence had been presented to support the charges made against him.
Mousef Ali Ben Mohamed Choubene, 41, living in Fgura, was accused of breaching the peace and assaulting two local wardens on 23 July 2004 in Fgura at around 6pm. The accused and the wardens gave completely different versions of the incident, with Mr Choubene claiming they insulted him and the wardens saying he opened the door of his car on one of them and punched him in the face. Presiding magistrate Giovanni Grixti ruled that insufficient evidence had been presented to support the prosecution’s case and therefore ordered Mr Choubene be acquitted. Inspector Malcolm Spiteri prosecuted.
