Court: Contract Ordered to be annulled

The Civil Court ordered a contract drawn up between two companies to be annulled after it was proven that it defrauded Carmelo and Carmen Magri.

The couple had filed a suit regarding the Lm19,444 in credit they were owed by Mixer Ltd and over the course of the proceedings, this company had signed assets, that is land in Zebbug, over to Mixer Concrete Ltd.

The Magris claimed that this contract denied them the credit they were owed, especially considering the same person is involved in both companies.

Despite the company claiming that it had no ties with the couple, the court, presided over by Mr Justice Joseph Micallef, ruled in favour of the Magris and ordered the contract in question to be annulled.

The two companies, Mixer Ltd and Mixer Concrete Ltd were also ordered to pay the court costs.

Dr Jose Herrera and Dr David Camilleri assisted the Magri couple.
