Objection To award of OHSA IT contract

An objection has been made to the recommendation of the General Contracts Committee on 22 September to award a contract for the development of a Management Information System for the Occupational Health and Safety Authority to Holistic Technologies Ltd.

The price of the recommended bidder was o153,000, excluding VAT.

Objections had to reach the Contracts Department by noon of 13 October together with a deposit of Lm688.

On 12 October, Megabyte Ltd filed a letter of objection in which it referred to a letter it had received from the Director of Contracts stating that its offer was “not technically compliant” as it did not garner the minimum number of 80 points.

Megabyte general manager John Ambrogio wrote: “We strongly object to this award on the grounds that Megabyte’s offer was cheaper than that of Holistic Technologies while maintaining the technical validity of the solution requested.

“In addition we believe that our offering is an innovative one, based on state-of-the-art technologies and supersedes those requested in the Tender document.

“We are in fact prepared to make a presentation to the evaluation committee to highlight the technical merits of our proposed solutions.

“According to the procurement rules in force you are kindly requested to inform us in which aspects the selected tender was superior to ours.

“In the meantime we expect you not to issue the acceptance letter to Holistic Technologies until this objection is properly addressed and Megabyte Ltd given the opportunity to demonstrate the technical validity of our proposal,” Mr Ambrogio concluded.
