A man was yesterday cleared of heroin trafficking with the court citing lack of evidence for a “safe” conviction.

Ryan Agius, 24, from Qormi, was cleared of trafficking heroin on and before 4 July 2002. He was also cleared of heroin possession and of committing the offences within 100 metres of an area frequented by youths.

In handing down judgment, the court pointed out that the fact that the accused was in possession of money which was used in a controlled delivery of drugs, was not enough to warrant a “safe” conviction.

The accused maintained that he did not abuse drugs and was only in possession of the cash because his friend who was with him at the time had carried out a drug deal and told him to hold onto the cash for him till they got home. The court took into account all evidence put forward and cleared the man of all charges brought against him.

Police Inspector Josric Mifsud prosecuted while Dr Joe Giglio appeared for the accused.
