The Malta Football Association (MFA) was yesterday ordered to pay e12,330.98 (Lm5,293.69) in premiums to Atlas Insurance PCC Limited which have been accruing since 2004.

The insurance company had asked that the association pay e12,330.98 (Lm5293.69) in accrued premiums, which it used to receive via an insurance broker, Alliance Malta Limited.

For its part, the association held that it should not be asked to pay the insurance as its legal responsibilities laid with the broker rather than with the agency. It also held that it was not in a position of knowing what did the broker owe to the agency.

The court, presided over by Mr Justice Lino Farrugia Sacco, explained through various previous judgments as well as jurisprudence that an insurance broker brokers contracts of insurance on behalf of the insured rather than the insurer. The court also that Atlas had proved that the association owed it e12,330.98 (Lm5293.69), which it ordered to pay.
