Driver, Deceased woman equally guilty of causing traffic accident

A man was ordered to pay e8,176.5 (Lm3,510) in damages to the children of a deceased elderly woman whom he ran over in 19 May 1998.

The Gozo Magistrates’ Court, presided over by Magistrate Anthony Ellul, found the driver, Saviour Mifsud, and the victim, Maria Conti, equally guilty to causing the traffic accident, and thus ordered Mifsud to pay for half the damages.

The woman’s children had sued Mifsud for damages, stating that he was entirely responsible for causing the accident which took place in Fortunato Mizzi Street, Victoria.

However, Magistrate Ellul held that the driver was not driving carefully enough in order to pre-empt the accident. He also stated that the woman was not crossing the street on a pedestrian crossing.
