Court: Woman Gets €326 compensation for green-stained arms

Malta Independent Tuesday, 27 October 2009, 00:00 Last update: about 17 years ago

A woman was awarded €326 in compensation after the feathers on a dress she bought for a wedding left a green tint on her arms.

Janice Xerri, the bride’s witness, found that after wearing the dress for some time her arms were stained with a green tint, which was impossible to remove for four days. Ms Xerri said she felt embarrassed during the wedding, which was why she decided to claim compensation from the bridal shop, Mrs Jones. The shop argued that Ms Xerri had tried the dress on several times before purchasing it, and it was only after the wedding that she came out with these claims. She admitted to using body lotion prior to the wedding, Mrs Jones argued. When they offered to remove the feathers, and sew them onto the waist, where they would not leave any stains, Ms Xerri refused. She refused to wear the dress in the shop, so the owners may see the effects with their own eyes and also declined their offer of an alternative dress. The tribunal decided to award Ms Xerri compensation, however “Mrs Jones” appealed the ruling. Magistrate Philip Sciberras rejected the appeal and concluded that the use of body lotion probably had nothing to do with the colour stains.
