Judge Farrugia Sacco loses appeal relating to claims that his rights were breached

Retired Judge Farrugia Sacco lost the appeal he filed against the Prime Minister, the Commission for the Administration of Justice and the Attorney General, in proceedings where he claimed his rights were breached.

The court decreed that the Commission for the Administration of Justice (CAJ) had not breached his rights when ruling that no fresh re-evaluation was required after the second impeachment motion, which was identical to the first, was filed following the 2013 general elections. The Court added that the Commission was not in breach when it said that there was no change from the original impeachment motion made by former Prime Minister Lawrence Gonzi and thus there was no need for re-evaluation.

The judge was found to have 'misbehaved' by the CAJ for retaining his post as president of the Malta Olympics Committee in breach of the judiciary's code of ethics. The CAJ found that there was evidence of misbehaviour on both occasions.

The Judge had reached retirement age in August before impeachment proceedings could take place.
