Allcare insurance has hit back at a judicial protest filed yesterday by a man who said that the company failed to payout on a claim after he suffered a heart attack whilst on holiday.

The insurance company said it was justified in refuting the claim, saying the decision was taken based on information provided by the man's doctor and the man himself.

Neville Azzopardi underwent a life-saving operation in an American hospital and is demanding that the insurance company honours its commitments and pays his hospital bills.

In Mr Azzopardi's judicial protest, he gave a run-down of what he went through last December while on holiday.

He explained that at the time his partner contacted the insurance agency they had purchased their travel insurance cover from which in turn asked his partner to contact Allcare's global response office based in the UK to discuss the medical bill payments.

He said that his partner had made contact with Allcare after the American hospital was asking for his insurance details before they could proceed with treatment.

But no information was forthcoming with the UK agency saying that Allcare in Malta failed to cooperate on the issue.

Mr Azzopardi was released from the American hospital after he was operated upon and the global response office informed him that All Care Insurance Limited was not accepting responsibility for the medical fees that ran into the tens of thousands of dollars. 

A meeting with the insurance firm after their arrival in Malta revealed that it had received information from Mr Azzopardi's family doctor that effectively nullified the travel insurance policy.

Mr Azzopardi said his family doctor had had a meeting with the insurance company in which he assured them that the information they had was incorrect and even issued a medical report that Mr Azzopardi led a healthy lifestyle, had no medical conditions and was in good health. 

Despite this, Mr Azzopardi said the firm was still refusing to honour its contractual obligations and warned of further legal action in the event it continued to refuse to pay up.
