A 54-year-old man who put his 89-year-old mother in hospital for over three weeks after beating her up has been given 20 days to vacate his mother's Paola home.

In her court affidavit, the mother explained that her son has an alcohol abuse problem, and whenever he gets drunk he loses control.

The mother ended up in Mater Dei hospital on 1 April 2015 after receiving a beating from her son.

She explained how she went to live in a garage in Paola because she was scared of her son, who continued to live at her house.

She confirmed in court that her son no longer has her permission to live there.

The man's brother, who also lives with his mother, told the court that the man has caused a lot of trouble, and confirmed that when he gets drunk he "loses control."

He said his mother spent from 1 April 2015 till 24 April 2015 at Mater Dei hospital as a result of the beating administered by his brother.

The man forfeited his right to legal representation and failed to prove he has any legal title to the property he is currently occupying. 

Madam Justice Lorraine Schembri Orland ruled that the mother has proven she is the one renting the Paola property, and the son was only allowed to live there with her blessing.

The son's behaviour was "intolerable and abusive," so much so that the mother was confined to living in a garage, and instead of showing respect, the son was violent towards his mother, the judge said in her ruling.

The son was made to pay all legal expenses related to the case.
