Speaker rules that motion for parliament to pass amendments clause by clause is admissible

A motion to regularise procedure on bills requiring different majorities has been deemed admissible, ruled Speaker Anglu Farrugia on Wednesday, as he added that the decision is also supported by legal advice.

The motion in question, motion of procedure 379 by the government, would allow the parliament to pass amendments clause-by-clause.

The Speaker said that Erskine May is "without a doubt" completely silent about this type of parliamentary procedure which concerns constitutional votes as indicated within the Constitution of Malta.

Within the ruling, Farrugia said that, according to the request of Nationalist Party MP Robert Cutajar, the motion of procedure in question is inadmissible as it allegedly goes against the Standing Orders, the Constitution itself, and Erskine May. But with that in mind, Farrugia said that the highest law of the land, being the Constitution, gives the power to the House of Representatives to do its procedure and everything that is necessary when the Standing Orders are silent, and even other procedure as from time to time there have been motions of procedure on various occasions during each legislature.

The Speaker said that, as is stated in the Constitution, "the House of Representatives may regulate its own procedure". He continued that therefore, the motion in question which was submitted by Deputy Prime Minister Ian Borg, "is a motion of procedure which is in accordance with the Constitution as already indicated and can certainly be tabled".
