Labour and Nationalist Members of the European Parliament have both written to their peers at the EP, putting different arguments and interpretations following the decision of the International Chamber of Commerce (ICC) in the arbitration case involving Steward Healthcare and the Maltese Government.
On Tuesday, Labour MEP and Deputy Leader for Party Affairs Alex Agius Saliba sent a letter to all Members of the European Parliament informing them of the outcome of the ICC tribunal, the Labour Party said. The tribunal, the PL said, rejected Steward Healthcare's claim for compensation after the Maltese Government terminated the hospitals' concession involving St Luke's, Karen Grech, and the Gozo General Hospital.
Agius Saliba said the tribunal upheld Malta's main defence and confirmed that the Government did not breach its contractual obligations. He stated that the decision dismissed what he described as "the PN's €400 million myth", adding that it confirmed Malta's commitment to transparency, good governance, and the protection of the public interest.
However, Nationalist MEP David Casa issued a separate letter to MEPs expressing strong disagreement with Agius Saliba's interpretation of the ruling. Casa said the outcome was not a victory for Malta, but rather "proof of failure".
He argued that the Maltese courts had already declared the hospitals' concession fraudulent and that the Government should have acted to recover public funds. Instead, he claimed, the Maltese taxpayer could now face further costs. Casa said the situation "potentially benefits those close to the government criminally charged with carrying out this fraud" and is "of undeniable detriment to the Maltese people".
The ICC tribunal on Monday rejected Steward's claim that the Government of Malta had unlawfully terminated the concession and owed it contractual damages, the government of Malta added.
The concession agreement over the hospitals deal had been annulled by the Maltese courts in February 2023 in a judgement that mentioned fraud, following a case filed by Adrian Delia who was the PN Leader at the time. A court of appeal had confirmed the decision later that year.
