Lands Authority unable to find contracts for St George’s Bay DB pool – Momentum

The Lands Authority cannot locate any documents relating to contracts, agreements of ownership, or concessions for the site being excavated and the demolition of boathouses to construct a pool in St George's Bay, Momentum has said.

"The Lands Authority has been searching for these documents since December last year and has requested additional time because it has not been able to locate them."

Matthew Agius, executive member of Momentum, said: "This is unacceptable and simply means that documentation does not exist. Private companies are taking public land as they please, and the authorities don't even try to stop them. While the Lands Authority searches for this FOI request, photos and video footage show that the area has already been cordoned off and that excavation works have begun, making way for a swimming pool and beach deck. Public land is being actively disturbed while we wait for excuses."

Momentum said that it is "against the culture of private companies taking over or using public land at the expense of public interest." Momentum said that it refuses to let coastal land be handed over without full accountability, transparency and public scrutiny.

"The silence of PL and PN is the result of their connection with the DB Group."

Agius added: "Unfortunately, the situation is even more sad, especially because the Opposition remains silent, happy to go have champagne drinks when invited by the same developers."

Momentum said that the original FOI sent last December requested: 1) A copy of any/all contracts/agreements of ownership, emphyteusis, lease, possession, encroachment or any other title or concession related to the area outlined in red (in a map included). The site is presently a boathouse/s in St George's Bay. 2) Minutes of meetings of the Board of Governors of the Lands Authority related to /all contracts/agreements of ownership, emphyteusis, lease, possession, encroachment or any other title or concession related to the area. The site is presently a boathouse/s in St George's Bay, including a reference to the Governors who were present. 3) Copies of any applications made for the said site by applicants. 4) Copies of the receipt of payments made for the said site. 5) Copies of any application made with the Lands Authority requesting permission to apply for development before the Planning Authority. 6) Copies of any response made by the Lands Authority in relation to 5. 7) Copies of any evaluation made as to the value of the site. 8) Full details of compensation paid/alternative property granted to the previous tenant/occupier. 9) Any tender issued in relation to the site. 10) Names of all bidders. 11) Winning bid.

Momentum said that it has now written to the Data Protection Commissioner.
