Five individuals were remanded in custody on Friday following a coordinated police operation targeting properties in Ħal Għaxaq and Ħaż-Żabbar, which resulted in the seizure of 140 packets containing around 80 grams of synthetic cannabis and 33 packets of cocaine.
The court heard that officers executed a search warrant at a flat in Ħal Għaxaq, forcing entry after knocking. Inside, police found Emerson Bugeja and Nicholas Richard Hansford Magri seated around a table allegedly packaging illicit substances into individual sachets, while Shaian Vella was seated on a sofa.
Officers seized 140 packets containing 80 grams of synthetic cannabis, while Bugeja was also found in possession of 33 packets of cocaine and a small quantity of cannabis grass.
Later that evening at 6:20pm, police intercepted Clayton Gatt and Daniel Inguanez outside a garage in Strickland Street, Ħaż-Żabbar. The prosecution stated that the duo went to the garage to move a BMW that Bugeja used, in an effort to conceal evidence from the police.
The defence representing Inguanez and Gatt challenged the validity of their arrest, arguing that they were not properly informed of the specific grounds for arrest at the scene and were shown only a single copy of a warrant.
However, Magistrate Jean Paul Grech declared the arrests valid, ruling that the search and arrest warrants clearly covered the premises and the suspects present, who were together throughout the operation.
The defence reserved the right to file a constitutional case alleging a breach of fair hearing rights. The arrests of Bugeja, Vella, and Magri were not contested.
Emerson Bugeja, Shaian Vella, and Nicholas Magri are being charged with trafficking and possession of synthetic cannabis not intended for personal use, as well as money laundering offences.
Emerson Bugeja is additionally being charged with trafficking cocaine, possession of cocaine not for personal use, and driving without a valid license or insurance policy.
Clayton Gatt and Daniel Inguanez are facing charges of attempting to destroy evidence of a crime and money laundering offences. Clayton Gatt is facing an additional Charge of permitting an unlicensed person to drive a vehicle.
All five defendants pleaded not guilty.
Defence lawyers submitted bail requests, calling the mothers of all five accused to the stand, who each testified that their children would reside with them if granted release.
The prosecution strongly objected to bail, citing a real fear of tampering with evidence.
Magistrate Jean Paul Grech denied bail for all five accused, ordering that they remain held in preventive custody.
Defence counsel Franco Debono argued that the court's decree completely ignored the defence's submissions.
In response, Magistrate Grech reminded Debono that he could formally contest the court's decision through the appropriate legal channels if he wished to do so.
