Former PN Secretary General Paul Borg Olivier loses libel case against L-Orizzont

Former PN Secretary General Paul Borg Olivier lost a libel case against L-Orizzont.

Borg Olivier felt defamed by an article which appeared on L-Orizzont in 2013 called "Between Facts and Interpretation". The article was based on an interview with an anonymous person claiming to be close to the PN. The article also referenced allegations which had emerged in a libel case concerning Nicholas Dimech, a former PN Sliema Mayor. Dimech had said he had been called by the PN Secretary General back in 2010 over a waste tender, allegedly urging the mayor to award to contract to a specific company.

Borg Olivier denied this and said that Dimech acted out of spite, after he was dismissed as mayor.

Magistrate Francesco Depasquale observed that the author of the article, aside from the anonymous source, also based the report on public allegations, although corruption was not proved. The court said that corruption allegations are a matter of public interest, especially when the person involved is in the political sphere.

Such allegations of corruption must be discussed in a democratic society, the court said, and debated fully and freely.

Nothing, the court said, should hamper citizens from commenting on cases of corruption or alleged corruption.
