Changes To delivery of summons regulations

Maltapost has been authorised to deliver these summons according to the procedures laid down within this Legal Notice.

Notification of a summons shall be effected by its delivery a) at any place in Malta or Gozo personally to the person on whom the summons is to be served; b) by leaving the summons at the postal address or last registered address of the addressee; c) by leaving the summons at the addressee’s place of business or place of work.

The summons may also be left with a member of the family or household, or with any person giving a service in that household.

Likewise, in the case of businesses, the summons may also be left with any person in the addressee’s service or employment, his or her attorney, or any person authorised to receive the mail.

For the purposes of this Legal Notice, “last registered address” is defined as the address as shown on the last issued Electoral Register and with regard to a registered company, the official registered address of the company.

Maltapost further notifies that in accordance with the procedures specified in this Legal Notice, two attempts at delivery shall be made, and in the event that such attempts prove unsuccessful, the summons shall be left in the addressee’s letter box at the registered address.

In instances where personal delivery of this summons is attempted, the postman shall ask for the name and surname of the person to whom the delivery is being made.
