After the Broadcasting Authority issued a statement claiming the court refused Smash’s first request, the company chose to re-apply for the injunction. The applications filed yesterday claimed there is a pending case in court between the two parties and therefore no action should be taken by the authority until the court has passed its judgement.

Smash had filed a court case against the Broadcasting Authority claiming it was hearing evidence and was aiming at passing judgement in a case it itself had filed against Smash, when the law states no-one can judge someone he himself has accused.

In its refusal of the first inhibitory injunction Smash had applied for, the court ruled the authority should continue hearing evidence against Smash on 5 October. In the application filed yesterday, Smash asked the court for this hearing not to take place until the other case is over. The application was filed by Dr Emmy Bezzina.
