Court: One Month in detention converted to Lm25 fine

A man who was found guilty of failing to pay his wife the sum established in his separation contract yesterday had his one-month in detention converted to a Lm25 fine on appeal. The man was originally found guilty of failing to pay his wife the sum agreed upon separation. The Appeals Court, presided over by Mr Justice Joseph Galea Debono, heard that the man had suffered a heart attack and lost his job and therefore could not continue paying support. Mr Justice Galea Debono said that this was not an excuse because he could have filed an urgent application for the contract to be changed. Mr Justice Galea Debono said that during the case, the man had paid his wife over Lm2,700 and therefore the punishment had to be decreased. He revoked the one-month detention punishment and changed it to a Lm25 fine. Dr Robert Abela appeared for the appellant.
