Court: AG’s Appeal thrown out

The Court of Appeal yesterday turned down an appeal filed by the attorney general in a drug possession case.

The appeal was filed by the AG’s office against Stephen Caruana. Caruana had originally been found guilty of being in possession of a cannabis plant and was given an 18-month conditional discharge. The AG’s office wanted a harsher sentence, claiming that the accused was actually in possession of cannabis resin.

The court, presided over by Mr Justice David Scicluna, turned down the appeal. Dr Jose Herrera and Dr Roberto Montalto appeared for the defendant.
