Court: Company Files constitutional case over expropriated land

Malta Independent Wednesday, 23 August 2006, 00:00 Last update: about 13 years ago

A company filed a case in the First Hall of the Civil Court in its Constitutional jurisdiction yesterday, claiming that the expropriation of a large piece of land by the government in 1976 was unlawful because the land is not being used for the benefit of the public.

Euro Finance Corporation Ltd filed the case against the Commissioner of Lands and the Attorney General.

In its application, the company claimed that, in 1976, the government expropriated land in Marsa measuring more than 180,000 square metres, that was subsequently leased to the Malta Shipbuilding Co. Ltd. It said the expropriation of the land was not in the public interest but only for commercial interests.

Euro Finance Corporation Ltd therefore claimed that the expropriation was in breach of its fundamental rights.

The write was signed by Dr Edward Zammit Lewis and Dr Jose Herrera.
