The biological father of a child born a year ago has also been declared to be the civil father.

The First Hall of the Civil Court, presided by Mr Justice Noel Cuschieri, declared that the child was born to a woman whose husband was an inmate at the Corradino Correctional Facility.

The mother filed a case in the First Hall of the Civil Court since her daughter, born a year ago, was registered as being her husband’s daughter, when in reality the biological father is another man.

The reasons behind the woman’s case are based on the fact that she and her husband have been separated since September 2004. Moreover, her husband had been jailed for 13 months and was released a month after the child was born.

The mother therefore argued on the fact that the child was conceived while her husband was in prison, so it was physically impossible for him to have been the biological father.
