The First Hall of the Civil Court yesterday refused a request for a prohibitory injunction filed by Alternattiva Demokratika to prevent the Malta Environment and Planning Authority from allowing development to go ahead according to the rationalisation process.
Mr Justice Ray Pace said that the request could not be acquiesced to because it was not proven that failure to issue the injunction would infringe on the complainants’ rights.
In addition, Mr Justice Pace said that AD did not prove that it had any right to prevent the development from going ahead.
