Marisa Turkdogan filed an application with the First Hall of Civil Court asking it to annul a management agreement she had undertaken with VAB Company Limited regarding the management of Jumbo Lido of Qui-Si-Sana, Sliema on 8 May 1997.
Ms Turkdogan said the lido had been given to VAB Company Limited on a temporary emphyteusis by the Lands Commissioner and was forbidden to sublet it to third parties without its consent.
She said that though their agreement was called a management agreement, in truth and reality it was an agreement to let her administer the lido, thus in breach of the emphyteusis agreement.
Ms Turkdogan said VAB Company Limited had not obtained the Commissioner’s consent prior to reaching an agreement with her.
She asked the court to nullify the management agreement and define it as a contract of lease after VAB had requested her to pay the management fee in respect of the agreement, even though the company was not allowed to enter into such agreements.
Ms Turkdogan said she had already paid thousands of Maltese liri in management fees. She also asked the court to order the company to reimburse her all the management fees she had paid since May 1997.
Dr Jose Herrera and Dr Veronique Dalli signed the application.
