Mr Justice Raymond Pace found Express Trailers Ltd responsible for the loss of part of a clothing consignment sent to the UK by Bortex Clothing Industry Company Limited.
Middle Sea Insurance, the clothing producer’s insurer that assumed Bortex Ltd’s legal rights in the case, filed the lawsuit.
The clothing company had commissioned the trailer company to transport its exports to the UK in a container.
When the consignment arrived at its destination, the receiving company found that part of the consignment, worth some €51,463.85, was missing.
The court considered that while the container was in Genoa port, the container was opened and rifled.
However, Express Trailers said it had no control and responsibility of the consignment while the container was in Genoa port.
Express Trailers were ordered to make good for the damage of €51,463.85.
