The man wrongly accused with a hold-up in Birkirkara last week, which case has been been withdrawn by the police, has filed a Constitutional application requesting compensation for his arrest and for being held in detention for three days.
Darryl Luke Borg, 27, of Birkirkara, was mistakenly accused of a hold-up on Wednesday because of miscommunication between different branches of the police force. Pleading not guilty, he was not granted bail but two days later, the police arraigned another man charged with the same hold-up, who admitted to the charges. Mr Borg was then granted bail before his case was dismissed on Tuesday.
His application was filed against the Attorney General, the Director of Courts, and the Commissioner of Police arguing he should never have been held under arrest because there was no reasonable suspicion against him.
He requested the Court to declare a breach of human rights.
The actions of police officers in relation to this case are being investigated by the Police Board which met twice since Saturday. Daryl Luke Borg was invited to testify in the last board meeting.
