UHM says tribunal has denied its members justice, files judicial protest

On July 8 2008, the Union Haddiema Maghqudin had registered an industrial dispute against Malta international Airport related to its employees which held the post of meteorologists.

The complaint had been heard by a Industrial Tribunal comprising lawyer Leslie Cushcieri as chairperson, along with members Charles Magro and Joseph Farrugia.

Recently, the tribunal had the opportunity to hear out the two sides.

After all the submissions were presented on 29 March 2011 to the truibunal, the tribunal postponed its decision but stopped short of setting another date related to its final decision.

Three years later, no date has yet been established and this despite various attempts made by the union protesting the case, calling on the tribunal to give its reason for the delay.

The union remained without a reply with the consequence that the complaints made by the union and members concerned were never addressed.

The union said that the tribunal had all the time in the world to discuss the proof presented to it and to emerge with a final decision.

The union said that such delays are not justified and the tribunal has seriously denied the right for justice to take place with its members.

In view of all the union’s protests, the union was left with no choice but to once again file a judicial protest calling on the tribunal to set the date when it would reveal its conclusions.

The complainant will hold the tribunal responsible in the event justice is further delayed.
