A Court has dismissed a constitutional application which was filed by Fabian Eliuth Garcia Parada, who faces charges over the murder of Sandra Ramirez.

The ruling, handed down on Tuesday by Judge Henri Mizzi, declared the application inadmissible, citing established legal precedent and principles.

The case dates back to January 13, 2024, when Ramirez had been killed, stabbed to death in her apartment in Sliema. Parada was charged the following day with murder, accused of intentionally causing her death or endangering her life. The prosecution is proceeding under Malta's 2022 law recognising femicide as an aggravating offence.

During his initial court appearances, Parada had asked the Magistrates' Court to refer a number of constitutional questions to the Constitutional Court. That request was turned down in February 2024, with the court finding the arguments frivolous or vexatious.

In May 2024, Parada filed a direct constitutional application, raising the same points that had already been rejected.

Judge Mizzi noted jurisprudence that once a lower court refuses to refer a constitutional matter, the same issue cannot be brought again through a fresh application.

The court therefore found Parada's petition null and ordered him to pay court costs.
