Court: Correctional Officer Claims breach of right to a fair hearing

A Correctional Officer at Corradino Correctional Facility has filed an application for a warrant of prohibitory injunction against the prison authorities, claiming that his right to a fair hearing had been breached when he was not allowed to be assisted by a lawyer during disciplinary proceedings.

Emanuel Cassar explained that he is facing disciplinary proceedings for alleged subordination and misbehaviour at work. He said that during an internal Disciplinary Board, he was not allowed to be represented by his lawyer which, he claimed, was a breach of his right to a fair hearing as guaranteed in the country's constitution.

Mr Cassar called on the court to issue the warrant of prohibitory in junction, stopping the Disciplinary Board from hearing the case in the absence of his lawyer.

Dr Jose Herrera and Dr Veronique Dalli signed the writ.
