A man has filed a judicial protest against Enemalta Corporation requesting it to correct an abusive situation it has created by reconnecting the electricity service for someone who is illegally occupying an apartment without the owner’s consent.
In the judicial protest, filed by John Camilleri in the First Hall of the Civil Court, Mr Camilleri explained that he is the owner of an apartment in St Paul’s Bay and had filed an application with Enemalta Corporation to remove the electricity meter.
However, he said, a certain Antoine Rapa moved in illegally and filed a request with Enemalta to start receiving electricity again. As a result, Mr Camilleri began receiving electricity bills.
Mr Camilleri said that when he informed Enemalta about the situation, they did not disconnect the service but started to send the bills to Mr Rapa without Mr Camilleri’s consent.
He pointed out that, even though he spoke to Enemalta Corporation several times asking them to rectify the situation and even though Enemalta admitted that they made a mistake and promised to do something about it, Mr Rapa was still listed and receiving the electricity bills.
In the writ, Mr Camilleri stated that he had already filed a judicial protest on 14 December against Enemalta who immediately filed a counter-protest.
In the counter-protest, Enemalta had stated that the place was not owned by Mr Camilleri and that the electricity meter was not registered in his name. As a result, it added, this issue should be resolved with the owner and not with Mr Camilleri.
In its writ, Enemalta had also stated that the situation was rectified and explained to Mr Camilleri.
However, Mr Camilleri had said that Enemalta had not solved the situation by simply sending the electricity bills to a person who was occupying the apartment illegally.
He went on to say that this abusive situation was created by the corporation without the consent of the owner.
Mr Camilleri said he was holding Enemalta responsible for all damages and called on it to remove the electricity meter as soon as possible.
