Malta Bargains Accuses Air Malta of unfair competition

Malta Independent Thursday, 29 December 2005, 00:00 Last update: about 11 years ago

Malta Bargains Limited yesterday claimed Air Malta allowed its (Air Malta’s) name to be used on a website called maltabargains.com, thus generating unfair competition.

In a judicial protest filed yesterday, Albert Borg, Malta Bargains Limited representative in Malta, explained how the company has been operative for a number of years and brings more than 75,000 tourists per year.

The protest was also filed by Palm Court Hotel Limited. This company runs the Palm Court Hotel in Qawra and accommodates the tourists brought over to Malta by Malta Bargains Ltd.

The complainants explained how they recently discovered that Air Malta is allowing its name and services to be used on a website called maltabargains.com. This site advertises holidays to Malta using Air Malta and also specifically names the Palm Court Hotel. The protest however noted that this is not the same hotel that belongs to one of the complainants.

Mr Borg and Palm Court Hotel Ltd therefore demanded Air Malta stop allowing its name to be used on this website as this is generating unfair competition to their detriment. The complainants are holding Air Malta responsible for any damage suffered.

The protest was filed in the first hall of the Civil Court by Dr Anna Mallia.
