MLP Telecom company loses trademark

The First Hall of Civil Court has issued a prohibitory injunction against the Malta Labour Party new telecom company to stop it using the name and logo ONE Mobile Ltd.

The injunction was issued after a rival company called One Telecom Ltd asked the court to stop the MLP communications company One Productions Ltd to stop using the name and logo.

One Telecom Ltd acquired the right to use the name in the telecommunications sector on 18 July. The trademark is “a number one circled in red with the word ‘Mobile’ written underneath the circle”.

On the other hand, One Productions Ltd is the owner of a trademark “consisting of the word ONE continued by the words ‘we are one’” which it acquired on 22 August and is licensed to use it in several services including telephony.

One Telecom Ltd claimed that confusion would reign should One Productions Ltd be allowed to use the logo and it would suffer serious financial problems. One Productions claimed it had always used the logo ONE throughout its existence and accused One Telecom Ltd of deceiving it by taking a free ride on its notoriety.

Mr Justice Albert Magri upheld One Telecom Ltd’s request and issued the prohibitory injunctions against One Productions Ltd.
